Frequently Asked Questions
Will I have to sell the farm during my divorce?
Not necessarily. The courts in England and Wales aim to achieve a fair, 50-50 outcome when dividing assets during a divorce, but selling a farm is rarely the first solution, especially if the farm is a working business or has been in the family for generations. Getting specialist advice early on gives you the best chance to protect your farming assets.
How is a farm valued during a divorce?
Due to the large number of asset and the complex structure of these assets, a specialist agricultural surveyor or valuer would be instructed to value the land, buildings, livestock, machinery and any farming business. Both parties in the divorce can instruct their own independent specialist or they can instruct an agreed, joint expert. The findings of this valuation would then be used to inform the financial settlement negotiations or court proceedings.
Can a pre or post nuptial agreement be used to protect inherited farmland?
While pre and post nuptial agreements in England and Wales are not legally binding, a well-drafted agreement is one of the most effective ways to protect inherited farmland in the event of a relationship breakdown. Courts will generally uphold an agreement providing they have been correctly drafted, both parties have received independent legal advice and the agreement is considered to be fair.
Is the process confidential?
Many farming communities are tight knit and so it is understandable to want to keep a personal situation such as a divorce, as quiet as possible. Discretion and confidentiality is something that is taken very seriously at Grant Stephens Family Law and we handle every farming case with the utmost care, understanding that reputation and community relationships matter enormously in rural areas.
