Frequently Asked Questions
How do I formalise arrangements for where my children will live?
If you and your former partner can agree on arrangements, these can be set out in a parenting plan, which is a written document that records what you have agreed. For greater security, agreed arrangements can be made legally binding through a consent order approved by the court. If agreements between both parties cannot be reached, either party can apply to the court for a Child Arrangements Order, which will set out where the children live and the time that they spend with each parent. We always encourage parents to explore mediation before court proceedings where it is safe and appropriate to do so.
Can I stop the other parent from seeing the children?
In most circumstances, the court considers it to be in a child’s best interest to maintain a relationship with both parents. Simply wanting to limit contact is unlikely to success unless there are genuine safeguarding concerns. If you have serious concerns about the children’s welfare during contact, there are legal steps that can be taken, including applying for a Prohibited Steps Order or supervised contact arrangements. We can advise you on the appropriate course of action based on your specific situation
The other parent is not paying child maintenance – what can I do?
If the other parent is failing to uphold their payments of child maintenance, you can ask the Child Maintenance Service to calculate and collect payments on your behalf. They have powers to enforce payment. In some circumstances, it may be more appropriate to have maintenance dealt with through a formal legal agreement or court order. We can advise you on the most effective route given your circumstances.
How is child maintenance calculated?
Child maintenance is usually calculated by the Child Maintenance Service using a formula based on the paying parents gross income, the number of nights the child spends with them and the number of children involved.
