Frequently Asked Questions About Unmarried Couples & Cohabitation
Do unmarried couples have the same rights as married couples?
No, unmarried couples do not have the same legal rights as married couples in England and Wales. There is no such thing as a “common-law marriage.” If you separate, you do not automatically have a right to claim a share of your partner’s property, pension, or ongoing financial support.
How can unmarried couples protect their assets?
Unmarried couples can protect their assets by entering into a Cohabitation Agreement (or Living Together Agreement). This legal document outlines how property, finances, and bills are shared during the relationship and how they will be divided if the relationship ends.
What happens to the house if an unmarried couple separates?
If the house is jointly owned, it will typically be divided according to the ownership shares stated on the property deeds. If the house is in one person’s name, the non-owner has no automatic right to stay or claim a share, unless they can prove they have made significant financial contributions or there was an agreement to share ownership under the Trust of Land and Appointment of Trustees Act 1996 (TOLATA).
