How do we reach a financial settlement?
A financial settlement can be reached in several ways, including an agreement made between the parties through negotiations via a solicitor, an agreement made between parties via mediation, or if parties cannot agree, then a financial settlement can be reached through the courts.
Our specialist family law solicitors here at Grant Stephens Family Law have a wealth of experience in negotiating financial settlements and can support and advise you throughout the process, making sure you receive a fair split of any combined financial assets.
When can a financial settlement be drafted?
A financial settlement can be drafted at any point during the divorce proceedings.
How do the courts decide what is a fair divorce settlement?
The court considers a number of different factors in making its decision.
These factors might include:
- The individual assets of each party involved
- Each party’s contributions to the marriage or civil partnership (both financial and non-financial)
- Duration of the marriage
- How much each party is likely to earn in the future
- If you have any specific requirements such as a disability
Do we have to go to court?
It is not a requirement to go to court if neither party want to and there are lots of methods that ex-spouses can use to reach an agreement.
Negotiation
In some situations, especially if the separation was amicable and there are not many assets to divide, parties are able to negotiate the settlement amicably. You can do this without a solicitor, but it is advised to seek legal advice prior, to ensure that your best interests are protected.
If both parties come to an agreement through negotiation, it is recommended that you seek support from a solicitor to help draft the financial order which will then be sent on to the court.
Mediation
Mediation is a popular way for couples to reach an agreement. Mediation is a form of alternative dispute resolution which involve an independent, third party to assist with communication and negotiations. The mediator will not provide legal advice.
If both parties reach an agreement via mediation, the mediator will draft a memorandum of understanding which details the agreement that has been made. The memorandum of understanding is not legally binding and must be incorporated into a draft a financial consent order, which is then sent to and approved by the court. It is at this stage that your financial settlement, whether achieved through mediation or not, is made legally binding.
To apply for a financial settlement through the courts, you will be required to have attempted mediation.
At Grant Stephens Family Law, we have an accredited family mediator as part of our team.
