Will finances be split equally?
According to the law, asset division during a divorce or civil partnership dissolution must always be fair, but that does not necessarily mean that the asset value will always be divided equally.
An equal split will likely be a starting point, but there are other considerations and factors that are involved, such as:
- The length of the marriage
- Each parties financial and non-financial contributions to the marriage
- The needs of the parties and any children involved
- The income, earning capacity, property and other financial resources which each of the parties to the marriage has or is likely to have in the foreseeable future
- The age and the health of the parties
- The standard of living during the marriage
- The conduct of the parties

Do we need to go to court?
It is not a requirement to attend court when dealing with the financial matters of a divorce. Attendance at court is only required if matters become contentious. Most are able to resolve financial matters voluntarily, through negotiations via solicitors. Where matters are contentious, and a formal court application needs to be filed, in the majority of circumstances, the courts require each party to have attempted mediation before you can apply to the courts to have your financial matter resolved.
When should financial matters be dealt with?
Financial proceedings can be dealt with in conjunction with your divorce and child arrangement matters. The divorce should not be finalised until a financial settlement has been reached. If you have a complicated asset portfolio, it is best to seek advice as soon as possible to best protect your future.
